Whiplash Claims

As a driver, passenger, cyclist or pedestrian, if you have suffered an injury on the road or pavement that has not been your fault, you can make a claim for compensation. Most road traffic accident claims that solicitors handle relate to whiplash compensation claims. Even if you have been a victim of a “hit and run” or you have been made aware that the party at fault does not have insurance, you can still make a claim. It is most important that you report the accident to the police as soon as possible after the accident, however.

As a passenger or pillion rider in particular, you are 99.9% guaranteed to win your claim. This is because your claim will be against the other driver or the person who was driving you around. This may mean you will have to sue your partner or friend if they caused or contributed towards the accident!

Examples of Road Traffic Accident Claims

Whiplash Injury ClaimsHere are just a few REAL case examples of claims successfully resolved by R. James Hutcheon Solicitors on behalf of their clients:

The classic rear end shunt Client X was driving his motor car and was about to slow down and stop at approaching traffic lights when another vehicle drove into the back of his vehicle. He sustained whiplash injuries for 6 months and was off work for 3 days. He received an out of court settlement £1950 for his injuries and £300 out of pocket expenses and losses. Solicitors and barrister fees were paid by the insurer on top of the compensation award. Client X therefore received 100% of the compensation.

Failure to stop at a road junction with motorcyclist injured – Client Y, a motorcyclist, was on a main dual carriageway when he noticed a motorist approaching a slip road. He moved into the outside lane but the motorist failed to notice him and collided with his bike knocking him to the ground. He sustained multiple injuries including a broken leg and collar bone. Some metal work was required to fix the broken leg. He recovered within two years from the accident and received an out of court settlement of over £14,000 plus loss of earnings/overtime at £24,000 and other out of pocket expenses. Solicitors and barrister fees were paid by the insurer on top of the compensation award. Client Y therefore received 100% of the compensation.

Elderly lady hit by a car in the middle of the road – Client Z, aged 72, was run over whilst crossing the road. The claim succeeded and an out of court settlement was obtained in the sum of £9,000 for a fractured hip bone and minor cuts and bruises. There was also an award for care by her family of over £2,000 and other claims for aids and appliances amounting to over £6000. Solicitors and barrister fees were paid by the insurer on top of the compensation award. Client Z therefore received 100% of the compensation.

Man injured by driver without insurance – Client B, father of 2, was attempting to walk across a road when a car hit him. He sustained multiple but thankfully only minor injuries. He was awarded over £3,000 even though the driver did not have any insurance. Solicitors and barrister fees were paid by the insurer on top of the compensation award. Client B therefore received 100% of the compensation.
