Whiplash injury compensation
A test case has put the insurance industry in the spot light. In the European Court of Justice ECJ it had to decide about a case where a tractor hit a ladder which resulted in a man falling to the ground causing injury.
Had this been on a public road it would not have been an issue but the accident happend on private property and the issue about insurance cover had to be considered.
The ECJ in the case of Damijan Vnuk v Zavarovalnica Triglav C-162/13, found that vehicles in their normal use have to be insured. This is a concept which is common sense but lost in legal argument. Insurance should be extended to offer protection against uninusred whiplash claims or personal injury claims following an accident either on public road or private road.
