Abstract:A man was working in his local supermarket. His back had begun to hurt twice within month as a result of heavy lifting. It was arranged that he would go on light duties until he felt he could go back to normal work.
He was also a body builder as hobby. He went to see the doctor about his pain. The x ray revealed that he had early sings of osteoarthritis which was not due to the manual handling accident at work. He was awarded £4,900 for general damages (accident at work compensation), though as he could still work on light duties he was not entitled to the difference in his claim for loss of earnings together with other losses and expenses.
